Rules Online Store Novu Indicating Terms and Conditions for Completion of Contracts Submitted Through the Website www.novu.fr
§1. Definitions
Turnaround Time – The time at which the order placed by the customer should be completed and given to the address at which the order should be executed. The time will not count the days on which the online store is expected to make the payment by the client (if you choose a payment method other than cash on delivery) and delivery.
Client – A person with at least limited legal capacity and 18 years, as well as a legal person or an organizational unit without legal personality, possessing the legal capacity and capacity to act.
Seller – Hereinafter referred to as Novu, leading online sales through an online store registered under the domain www.novu.fr. The owner of the store is Novu Sp. z o.o., Królewska 65A/1, 30-081 Kraków, identification number: 381277166, tax identification number: PL6772437651, KRS number 0000748216.
Goods – The articles on which you can place an order in the online shop.
Working Days – All days of the week from Monday to Friday, excluding public holidays and Saturdays.
Costs of Delivery – The costs incurred for the purpose of providing the goods to the purchaser in accordance with the order made by them.
Foreign Order – An order, which delivery is to take place within the European Union, outside Poland.
§2. Conditions Ordering
- The persons authorized to place orders for goods are customers: a) Having the status of a registered user online store. b) Not having the status of a registered user shop – who purchase without following the procedure of registration and login status.
- Customers are required to keep the data necessary to place orders in the online shop, so as to prevent them from being read by unauthorized third parties.
- The online store is one of the communication tools of Novu. Therefore, not all of the goods presented on the online store may be available for purchase via the internet. The information presented on the online store does not constitute an offer within the meaning of the Civil Code but is an invitation to tender by the customers. The conclusion of the sales contract requires the prior submission of an order by the customer, then its verification by Novu, among others, in terms of availability of goods.
- A customer having the status of a registered user can place an order by logging in to the online store, adding the goods presented in the online shop to the cart, and then confirming the order for goods by selecting the button “Checkout”. Preliminary verification of your order will be made by sending an email to the customer about the order.
- A customer not having the status of a registered user can place an order by adding the goods presented in the online shop to the cart, then confirming the order for goods by selecting the button “Checkout” and providing the information required to complete the contract in accordance with the procedure set out on the website of the online shop. Preliminary verification of your order will be made by sending an email to the customer about the order.
- Making purchases in the online shop is possible 24 hours a day every day of the year, while they take place on weekdays.
- Novu reserves, in justified cases, the right to further verify the customer’s data, for example, by telephone contact.
- §3. Price and Payment
- The amount of the price specified in the online shop is binding and cannot be subject to negotiation. The price of the goods specified in the online shop does not include shipping costs realized in Poland. In the case of foreign orders, the price of the goods will include the cost of shipping. The amount of freight charges is given in the basket during the ordering process.
- The customer has the right to choose the following forms of payment: a) Credit card payment via the service Mollie. b) Transfer payment via the service Mollie. c) Payment by cash (on delivery) into the hands of a courier, subject to paragraph 4.
- The condition of the order, if you choose a payment method other than cash on delivery, is a payment already made for the ordered goods.
- Novu delivers goods to the client, together with the sales document or a VAT invoice if the client has requested the issue when making the order and provided the necessary data for the invoice. The sales document confirms the contents of the order.
- The available payment methods for the order are credit card, debit card, transfer, and Mollie.
§4. Newsletter
- The customer has the ability to receive information in the order form newsletter online store for their given email address. Placing an order for the newsletter ensures that the customer is authorized to dispose of the email address, which is to be sent.
- At any time, you are entitled to withdraw from the newsletter.
§5. Personal Data
- The customer, by registering in the online shop, consents to the collection and processing of their personal data by Novu, given in the form of personal data within the meaning of the Act of 29 August 1997 on the Protection of Personal Data (Journal of Laws of 2002 No. 101, item 926, as amended), solely for the purpose of the contract of sale, promotional campaigns, advertising, and maintaining data security requirements specified in the regulations cited above.
- The customer can also opt to receive information from Novu, including advertising and trade, by means of electronic communication.
- The customer has the right to inspect the contents of their personal data, correct it, and request deletion.
§6. Final Provisions
- In matters not regulated by these provisions, the Civil Code and the Act on the Specific Conditions of Consumer Sale and Amending the Civil Code, and the Law on the Protection of Consumer Rights and Liability for Damage Caused by Dangerous Products, shall apply. These provisions do not affect the rights of consumers in respect of non-conformity.
- All names of products offered for sale through the online store are used for identification purposes and may be protected and registered under the provisions of the Industrial Property Law.
- The shop owner reserves the right to unilaterally amend these rules at any time and without having to justify the cause.
